1. Acceptance of Terms

By accessing or using the e-invitation wedding platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes. We encourage you to review these Terms periodically.

2. Service Description

e-invitation wedding is a platform that enables users to create and manage elegant wedding websites, digital invitations, guest lists, RSVPs, and related wedding planning tools. The Service includes website hosting, template customization, guest management, email and SMS communications, media storage, and payment processing for premium features.

3. Account Responsibilities

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials and not share your password with others.
• Promptly notify us of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 16 years of age to create an account. By creating an account, you represent that you meet this age requirement.

4. Acceptable Use

You agree to use the Service only for lawful purposes related to wedding planning and celebration. You may not:

• Upload or publish content that is offensive, defamatory, obscene, hateful, discriminatory, or otherwise objectionable.
• Use the Service to send unsolicited communications (spam) or harass any person.
• Upload malware, viruses, or any harmful code.
• Attempt to gain unauthorized access to the Service, other user accounts, or our systems.
• Use the Service for any illegal purpose or in violation of any applicable laws or regulations.
• Reproduce, duplicate, sell, or resell the Service or any portion thereof without our express written permission.
• Upload content that infringes on the intellectual property rights of others.
• Use automated scripts, bots, or scrapers to access or interact with the Service.

We reserve the right to suspend or terminate accounts that violate these usage policies, with or without prior notice.

5. Intellectual Property

Our Property

The Service, including its design, templates, code, logos, trademarks, and documentation, is owned by e-invitation wedding and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

Your Content

You retain ownership of all content you upload to the Service (photos, text, media). By uploading content, you grant us a limited, non-exclusive license to store, process, display, and transmit your content solely for the purpose of providing the Service. This license terminates when you delete your content or account.

6. Payment Terms

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to the following:

• Payments are processed securely through Stripe. We do not store your credit card information on our servers.
• Subscription fees are billed in advance on a recurring basis according to the plan you select.
• All fees are non-refundable unless otherwise required by applicable law or stated in our refund policy.
• We reserve the right to change pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle.
• If payment fails, we may suspend access to premium features until the issue is resolved.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance. We are not liable for any loss or inconvenience resulting from Service interruptions.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• e-invitation wedding shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service.
• Our total aggregate liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
• We are not responsible for the content, accuracy, or availability of third-party services integrated with the platform (Stripe, Resend, Twilio, AWS, Sentry).

9. Indemnification

You agree to indemnify and hold harmless e-invitation wedding, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including the intellectual property rights of others.

10. Termination

You may terminate your account at any time through your account settings or by contacting us. Upon termination:

• Your wedding website will be taken offline immediately.
• Your data will be retained for 30 days to allow recovery, after which it will be permanently deleted.
• Any active subscription will be cancelled, and no further charges will be made.
• Previously paid fees are non-refundable upon voluntary termination.

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in conduct that we determine is harmful to the Service, other users, or third parties.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration association in the jurisdiction specified below.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Montreal, Quebec, Canada for any legal proceedings arising from these Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and e-invitation wedding regarding your use of the Service, and supersede any prior agreements or understandings.
